General Terms and Conditions (GTC)
Office Mate International Technologies (OMIT), Inc. and OMIT Canada, Inc.
PLEASE NOTE: The following terms and conditions govern the sale by OMIT of computer systems and/or related products and/or standard services (hereinafter "Product(s)"). By accepting delivery of the Products described on the invoice/packing slip that will be provided to the Customer, Customer agrees to be bound by and accepts these terms and conditions.
THESE TERMS AND CONDITIONS APPLY: (i) UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH OMIT, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN OR (ii) UNLESS OTHER OMIT STANDARD TERMS APPLY TO THE TRANSACTION.
These terms and conditions are subject to change without prior written notice at any time, in OMIT's sole discretion.
Shipping Charges and Tax
Prices shown in the eStore (Emporium), WebStore and/or Promotions section do not include provincial sales taxes (PST), harmonised sales taxes (HST), Federal goods & services tax (GST), as pertaining to Canadian orders, Indiana Sales Tax, as pertaining to Indiana state sales, or shipping and handling charges, if applicable. Taxes, shipping and handling charges are calculated after order processing information is entered. OMIT will collect from, and Customer is responsible to pay for, sales and all other taxes associated with the order.
Ordering and Quotes
While we will make every attempt to ensure that orders and quotations are processed with the utmost of care, certain guidelines should be observed:
- Quotes:
- All prices are calculated in the currency presented on Requests For Quotation, or in US Dollars if not otherwise specified.
- We take pride in our efforts to locate the best and lowest price possible on all products offered. Our research takes into consideration retail, OEM, distribution, tiered and international markets. Prices quoted will remain in force and firm until expiration of the quotation.
- Any quotations given by OMIT will be valid for the period stated in the quotation. If not indicated on the quotation, the default effective period is seven (7) days from issued date of the quotation. This period is not alterable.
- Viewers and customers should be aware that OMIT cannot guarantee or reserve prices. Prices in the computer industry are prone to frequent adjustments. It is because of this that quotes are only effective for a short time.
- Adjustments to Quotes are only valid where signed and executed by authorized staff.
- We will not be responsible for typographical or other errors or omissions regarding prices or other information. Also, OMIT cannot be held liable for promises or terms made by its employees or agents that may conflict with these General Terms and Conditions or any other OMIT posted Terms.
- Although configurations and products are subject to change without notice due to unforseen occurrances originating with our suppliers, we will always try to replace the item(s) affected with similar or better products.
- Shipping and handling are not quoted and taxes will be charged where applicable.
- Orders:
- If not indicated on the Order, all prices and figures are assumed to be in US Dollars.
- Orders are not binding upon OMIT until accepted by OMIT.
- Orders will not be processed until payment for such orders is confirmed by OMIT.
- Processing schedules can be seen on the Delivery Methods and Times page.

- Although we will always try to ensure that product will be available at the time of ordering, we cannot guarantee prices and availability on high demand products or items purchased during high demand seasons. High demand items include, but are not exclusive of: memory, processors, video cards, sound cards, hard drives, cameras, software, and computers. High demand seasons include: Christmas (December 15th to December 29th), New Years (January 1st to January 31st), and Back-to-School (August 1st to September 30th).
- Customized Systems:
- Customized Systems include: OMIT branded personal computers (tower and desktop), laptops, and servers.
- Since Customized Systems are configured using available components and parts, the build time and final configuration will depend on the availability of each component. High demand items that may affect configuration include, but are not limited to, memory, processors, video cards, sound cards, hard drives, and motherboards.
- Backordered components that are required to complete the Customized System will delay the finalization and delivery of such system.
- Pre-Payment terms are required to finalize all orders which include Customized Systems. Customers purchasing Customized Systems in an OMIT store are required to pay at the time of order. Online customers will always pay at the time of ordering, regardless of product being purchased.
- Customized Systems are covered by the standard warranty pertaining to the said equipment.
- Build-times will depend on time to ship components.
- Order Acceptance and Completion:
Order acceptance and the completion of the transaction will take place when the goods ordered are shipped to the address designated by customer on order page unless the customer has been notified that OMIT does not accept the order or the order has been cancelled in accordance with our Terms and Conditions.
Non-acceptance of an order may be a result of one of the following:
- The product ordered is currently unavailable from stock
- Payment authorization could not be obtained
- There has been an identified pricing or product description error
- Order or payment is suspected to be fraudulent
OMIT reserves the right to decline any order and withhold deliver of the goods ordered. Should payment have been made, OMIT reserves the right to refund the designated credit card number the full amount of the order."
Payment Terms and Interest:
Terms of payment are within OMIT's sole discretion, and unless otherwise agreed to by OMIT, payment must be received by OMIT prior to processing of said order.
- CREDIT CARD PAYMENTS: We accept Visa, MasterCard, Discover and Novus. We do NOT charge "surcharges" for credit card transactions. Please read the Privacy & Security Statement for more details on secure credit card usage on the net.
Credit card payments are authorized online in real time. You will be informed immediately if your credit card is approved. If declined, you may check the accuracy of the credit card number and expiration date, or choose a different card to try. Your order will NOT be sent unless the credit card number you entered is authorized and validated. Furthermore, products ordered by credit card will only be shipped to the valid credit card billing address.
You must provide us with a working phone number in order for us to contact you to confirm your order and in case of problems with your order.
OMIT is very aggressive in getting law enforcement involved in cases of obvious credit card fraud. We diligently check all purchases and act severely if fraud is suspected. Do not try here! Or ANYWHERE for that matter.
In an attempt to minimize purchases using stolen credit cards or card numbers, OMIT does not ship to certain marked countries. If you are purchasing from any of these countries with your own finances, you are more than welcome to contact us directly.
If you do not feel comfortable transmitting your credit card number and other information on the Internet, we suggest you place an order online, choose "Credit Card via Phone" as the payment method, and then phone in to give us your credit card number over the phone. We'll charge your credit card manually.
- CERTIFIED CHECK PAYMENTS: Pre-payment with certified cashier's check or money order is accepted. You can place the order online, select "Cert. Check/Money Order" as payment method. Then get a cashier's check or money order from your bank for the exact amount and mail the check with a copy of the order sheet to us. We'll ship your products within 1-2 business days after the check is cleared from the bank. Your order will be canceled if we do not receive your payment in 10 business days or the check/money order is invalid. Orders via certified cashier's check or money order are not confirmed until payment is received. We do not accept personal checks.
- WIRE TRANSFER (T/T): After you place your order, details about the wire-transfer process will be emailed to you on the same or subsequent email notification. If you missed that e-mail, please call or email us. We'll give you details over the phone on how to do a telegraphic transfer. You must place the order first before calling for the transfer information. The total transferred must include all costs. The shipping cost may be adjusted for international addresses and over-weight orders. Delay in shipping your order may occur if the wire-transfer received is different from the order total amount. Wire-transfer may take 1-2 business days to confirm. It must be confirmed by our bank before shipping can take place.
Chargebacks and Refunds
Refunds are outlined and are handled according to OMIT's Refund and Return Policy. If it is determined that funds are to be refunded for a purchase, such refund, chargeback, or reimbursement shall exclude the nominal restocking fee (currently 15% of the purchase price of the products ordered), set from time-to-time by OMIT, and all freight charges, where applicable.
Product Availability
Limited stock available. Promotional offers are valid only while supplies last. Prices may fluctuate; call for current pricing. Products may not be available for immediate delivery.
We only sell and stock new, manufacturer warrantied products. Grey market or unlabeled, white-box items are not represented by OMIT in any form.
Delivery Terms
These delivery terms supersede any delivery information supplied by OMIT elsewhere. We ship promptly based on Product availability. Please call 1-888-OMIT-688 for availability.
- Orders purchased with a credit card will only be shipped to the valid credit card billing address.
- Products are limited to quantities provided on a First Come First Served Basis. Product availability cannot be guaranteed.
- You must provide a delivery address; we cannot ship to P.O. boxes.
- Some locations may require additional delivery time. We will make every effort to inform the Customer of delivery delays within our knowledge.
- Title to products being shipped remains with OMIT until it is received by the customer, and risk of loss passes upon delivery by our carriers.
- All domestic shipments are insured at no additional charge.
- OMIT is not responsible for shipping or other delays caused by events beyond our control.
- UPS does not guarantee shipments to residential addresses for during the week before Christmas.
- Our shipping program sometimes does not calculate shipping correctly in the following situations: International addresses, and if total weight of all items exceeding 100lb. Manual adjustment of shipping cost may be necessary in these situations.
- UPS does not normally deliver on Saturdays. Saturday delivery is very expensive. It typically costs 50-100% more of the next-day air shipment with a minimum $25.
Export
Products obtained under these Terms and Conditions may be subject to Canadian or U.S. government export control regulations. Customer assures that it will comply with those regulations whenever it exports or re-exports controlled Products or technical data obtained from OMIT or any Product produced directly from the controlled technical data.
Governing Law
These Terms and Conditions and all related transactions will be governed by the laws of the State of Indiana and Province of British Columbia and the applicable laws of the United States of America and Canada.
